Position Summary:
Reporting to the Chief Diversity Officer and at the direction of the Human Relations Officer, reviews, adjudicates, investigates and/or provides oversight for the
investigation, adjudication and processing of matters involving Middlebury's Non-Discrimination Policy (including discrimination matters, sexual harassment, sexual misconduct,,sexual assault), domestic and dating violence, stalking, other harassment on the basis of a protected class), and related retaliation matters for all Middlebury programs. Middlebury programs include but are not limited to the undergraduate program, Language
Schools, Schools Abroad, Bread Loaf School of English, Bread Loaf Writers Conference, School of the Environment, Middlebury Institute of International Studies at Monterey, and MiddCore.
Develops, conducts and/or or oversees Middlebury's sexual violence, discrimination, and harassment prevention and response efforts for all Middlebury programs.
Conducts investigations and adjudications, including presiding over hearings, under applicable Middlebury policies and procedures.
Works with officials in all Middlebury programs to help coordinate, develop, and/or implement anti-discrimination, anti-harassment, and sexual violence education programs, policies, procedures and materials for all faculty, staff, and students in all Middlebury programs.

Essential Functions:
Offer is contingent upon successful completion of a criminal background check.

  • Works collaboratively with state and federal agencies assigned to review and process discrimination, harassment, sexual misconduct (including sexual assault), domestic violence, dating violence and stalking complaints filed against the College.

  • Maintains the highest level of confidentiality in all harassment, discrimination, sexual misconduct, domestic and dating violence and misconduct, stalking and related retaliation matters.



  • Reviews, adjudicates (including, where applicable, presiding over hearings), oversees or conducts investigations and/or processes discrimination, harassment, sexual misconduct, domestic and dating violence, stalking and related retaliation complaints/ reports in accordance with Middlebury’s policies. Works collaboratively with the Judicial Affairs Officers to process cases under Middlebury’s policies.

  • Issues official written determinations regarding alleged policy violations under Middlebury’s Non-Discrimination Policy.

  • Serves as one of two point people for the implementation of Middlebury’s Non-Discrimination Policy and other related policies or procedures in connection with all Middlebury programs, including the undergraduate program, Middlebury Institute of International Studies at Monterey, Bread Loaf School of English,

  • MiddCore, Language Schools, School of the Environment, and the Schools Abroad.

  • Works collaboratively with other Middlebury departments in all programs to: ensure compliance with all applicable Middlebury policies and procedures; develop and/or conduct mandatory harassment and sexual violence training and education for faculty, staff and students; and develop and disseminate related policies, resource information and other prevention and response materials.

  • Issues orders or takes other steps as necessary to protect complaining parties on an interim basis; issues determinations and plans and refers matters to the appropriate supervisory authorities for disciplinary action in accordance with applicable policies.

  • Ensures that Middlebury’s harassment, discrimination, and sexual violence policies comply with all applicable state and federal laws. Drafts new policies and/or revises existing policies as necessary to ensure compliance and consistency across all Middlebury programs.

  • Keeps confidential records and reports of harassment, discrimination, sexual misconduct, domestic and dating violence and misconduct, stalking and related retaliation and any actions taken in response thereto.

  • Works collaboratively with the Civil Rights and Title IX Coordinator, and other offices as appropriate, to track reports of discrimination, harassment, sexual misconduct, domestic and dating violence, and stalking matters for internal and regulatory statistical purposes and contributes to regular reports for the President concerning the number, nature, and disposition of such reports.

Qualifications
Education:

BA Required; Masters or JD degree preferred

Knowledge, Skills and Abilities:
  • Significant working knowledge of applicable state and federal laws



  • relating to unlawful harassment, discrimination, sexual violence, ADA, affirmative action, Title IX, Clery and employment.

  • Excellent communication, interpersonal, and cultural competency skills. Knowledge of second language and/or experience with issues related to transnational and intercultural communication preferred.

  • Ability to oversee investigations, evaluate cases and render decisions based on a thorough, impartial and objective analysis of the evidence and applicable law and policy; and exercise good judgment in a variety of situations.

  • Requires superior written and verbal communication, administrative, and organizational skills. Must be able to work under pressure and handle confidential matters with discretion.

  • Demonstrated cultural competence.

  • Proven effectiveness in serving the needs of a diverse campus community

  • Ability to travel on occasion for trainings or investigations at other Middlebury sites.


Experience:
3-5 years experience in the areas of student affairs, law, employment, affirmative action, or diversity; experience in a higher education setting, preferably in the area of Title IX.
