About the Job
The Academic Health Sciences Counsel (AHS Counsel) reports to the General Counsel of the University, and provides sophisticated legal support to the University’s health sciences schools and colleges which exist in a complex and highly regulated environment involving research, teaching, and the provision of clinical services. The AHS Counsel in collaboration with other colleagues in the Office of the General Counsel, provides advice and counsel to senior leaders within the University, including the Deans and Associate Deans of the Medical School, School of Nursing, School of Dentistry, College of Pharmacy, College of Veterinary Medicine, and School of Public Health, as well as the leadership of other units, and works in close cooperation with University of Minnesota Physicians (UMP), the non-profit corporation through which the approximately 1,000 medical faculty conduct clinical practice.
The AHS Counsel negotiates and creates agreements over a broad range of health-related issues, both on a day-to-day basis, and at a strategic level. The negotiation skills and legal acumen of AHS Counsel are essential to the success of the University in the healthcare marketplace. The University’s academic mission of teaching and research as it enters any new relationship or venture is particularly important.
The AHS Counsel will be expected to be familiar with regulatory and compliance issues related to health care, research, and education, and will regularly work with the General Counsel to advise University leadership in that arena. The AHS Counsel is responsible for providing legal advice related to clinical services, including student health services and the University’s federally qualified healthcare clinic, Community University Health Care Center. The AHS Counsel addresses regulatory and privacy matters related to federal and state laws including but not limited to Medicare and Medicaid, Stark law, Anti-Kickback Statute, False Claims Act, scope of practice, and HIPAA. The AHS Counsel is also responsible for academic affiliation agreements to establish clinical training sites for health sciences students nationwide and in many foreign locations.
The AHS Counsel is responsible for risk management, and the management of litigation arising out of the activities of health sciences students, particularly medical residents and fellows. All students in the health professions have an experiential component to their educational program, and at any given time, there are over 1,500 trainees at a clinical site.
Qualifications
Required Qualifications
- J.D. from an ABA accredited law school
- At least 12 years of healthcare law experience in an academic medical center, hospital, or health system or in a firm performing legal services for hospitals, health systems, academic medical centers, or physician practices.
- Admission to and good standing in the State Bar of Minnesota, or eligible for prompt admission.
- Demonstrated knowledge of healthcare regulatory issues and the healthcare environment.
- Excellent communication skills
- The ability to maintain relationships with a broad and diverse array of leaders, faculty, and administrators throughout the University and its AHS.
- Creative problem solving skills and sound legal judgment are also requirements for this position.
Pay Range: $180,000 - $225,000 ; depending on education/qualifications/experience
Time Appointment: 75%-100% Appointment
