The Assistant Vice President for Institutional Equity/Section 504 Coordinator is a key leadership position and serves as the Equity Compliance Officer who supports the University’s commitment to equity with the oversight of the university’s response to reports of bias, harassment, violence and other forms of discrimination and harassment.

The AVP for institutional Equity / Section 504 Coordinator has compliance responsibilities for various federal and state regulations, including Title IX of the Education Amendments of 1972, the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act of 1973, Title VI of the Civil Rights Act of 1964, the Age Discrimination Act of 1975, the Violence Against Women Act (VAWA), Clery, Title VII, Family Education and Privacy Act (FERPA), and related civil rights in higher education as well as University policies prohibiting discrimination or otherwise designed to assure equitable education and work environments.

The AVP for Institutional Equity/Section 504 Coordinator will provide strategic leadership for the University in the development, implementation and monitoring of equity compliance programs. Supervise the work and professional development of a team that conducts, oversees and tracks independent investigations of complaints, design and conduct training, and recommend solutions for issue resolution. This person is expected to operate with a compassionate nature and exercise active listening when dealing with individuals. This person is also responsible for the annual review and update of all policies and procedures related to Title IX compliance and Antidiscrimination and Anti-Harassment. This position reports to the Associate Vice President of Audit, Risk & Compliance/Chief Risk Officer.

Minimum Qualifications:

• Juris Doctorate OR Master's degree in student affairs, higher education, public administration, law, social work, counseling or similar field. In lieu of a Juris Doctorate or Master’s Degree, a Bachelor's degree from an accredited four year college or university with a minimum of five years experience in related field with extensive experience in Title IX of the Education Amendments of 1972, the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act of 1973, 2 Title VI of the Civil Rights Act of 1964, the Age Discrimination Act of 1975, the Violence Against Women Act (VAWA), Clery, Title VII, Family Education and Privacy Act (FERPA), and related civil rights in higher education and employment law and policy.
• Five (5) years of professional experience that includes or demonstrates: Comprehensive knowledge of and experience with Title IX compliance issues; Knowledge of government regulations that pertain to students, faculty and university staff, including Title IX, VAWA, Section 504, the Americans with Disabilities Act, and other anti discrimination laws and regulations.
• Supervisory and management experience.
• Experience developing, facilitating, and evaluating educational and training programs In
the area of civil rights
• Effective written and verbal communication skills.

Preferred Qualifications:

While not everyone may possess all of the preferred qualifications, the ideal candidate will bring many of the following:

• Experience in a higher education, judicial, or regulatory compliance setting.
• Experience in conducting alternative resolutions, such as mediation, alternative dispute resolution, restorative justice, etc.
• Experience leading and/or collaborating with civil rights investigators.
• Deep knowledge of civil rights law and policy that applies to higher education and employment.
• Demonstrated understanding of the University of Dayton’s mission and vision and commitment to Equity; Open Communication; and Accountability.
• Strong presentation and facilitation skills with an emphasis on education and training for a variety of constituencies.
• Experience working with confidential and sensitive information.
• Strong analytical and critical thinking skills with the ability to problem solve, prioritize, analyze, summarize, and effectively summarize data.
• Demonstrated commitment to diversity, equity, and inclusion and experience working effectively with individuals from diverse backgrounds, in support of an inclusive and welcoming environment.
• Knowledge of best practices in higher education compliance with respect to effectively addressing discrimination, harassment, and retaliation.
• Ability to act independently, take initiative, and exercise sound judgment.
• The courage and integrity to pursue action consistent with the goals of civil rights laws and University policy, even in the face of vocal or powerful opposition.
• Commitment to the mission and vision of the University of Dayton and its Catholic and Marianist heritage.

A federal court on December 7, 2021, issued a ruling that suspends the COVID-19 vaccine requirement that applies to federal contractors nationwide. With this development, the University will pause any enforcement action against employees who have not complied with the requirement to be fully vaccinated by Dec. 8, 2021 or to have requested an exemption to maintain their employment status.

The University will continue to monitor the state of the pandemic on campus and in the community as well as developments in federal and state requirements, and also will continue to regularly consult with public health officials and our medical panel. As has been the case throughout the pandemic, our protocols and requirements are subject to change depending on conditions on campus or in our community, and government requirements.
