Associate General Counsel - Employment

Position Category: Staff - Full-Time

Summary:
This position primarily provides advice and counsel (both proactive and reactive) related to employment law generally, along with Title IX/EEO discrimination laws, wage and hour laws, GRAMA, higher education law, privacy laws, compliance matters, disability law, and other areas as assigned by the General Counsel or their designee. Tasks may involve internal investigations, internal hearings, collaborating with outside counsel, creating and delivering training workshops to internal stakeholders, and research on pressing and/or developing legal matters. This position exercises case management over matters filed in state and federal court, with state and federal agencies, and in conjunction with internal hearing processes. Research, draft, and/or edit filings on behalf of UVU in coordination with internal stakeholders and outside counsel. Assists with litigation and charge management, research, and response. Drafts memos, correspondence, charge responses, policies, and other documents. Prepares and/or presents reports, and recommendations, and trainings. Provides legal counsel to administrators and managers within UVU.

Required Qualifications:
  • Juris Doctor from ABA accredited law school.
  • A minimum of 5 years of law firm or in-house experience practicing labor and employment law.
  • Experience in conducting/supervising internal investigations.
  • Litigation experience in employment matters, including trials and/or arbitrations.
  • Must be licensed to practice law in Utah and in good standing with the Utah Bar. If licensed in another state, must be in good standing with the State Bar of that state (or those states) and willing and able to become licensed in Utah within 6 months.


Knowledge, Skills and Abilities:
  • Strong communication skills, good professional comportment with ability to interact with high level executives and administration, including accrediting agencies.
  • Emotional intelligence, tact, and resilience; ability to facilitate solutions and gain compromises without damaging relationships; lead by influence and consensus; and maintain confidentiality and exercise discretion in addressing sensitive topics.
  • Intercultural competence, awareness, and communication; demonstrated commitment to inclusion.
  • Ability to work on multiple projects independently and simultaneously.
  • Knowledge of legal processes, legal research methods, brief writing, letter writing, memo writing is required. Knowledge of higher education laws are a plus.

  • A high level of self-initiative, with the ability and willingness to eagerly assume assigned responsibilities.
  • Demonstrated ability to maintain confidentiality.
  • Knowledge of higher education laws and regulations.
  • Knowledge of relevant US federal and state employment laws and labor relation legislation.
  • Familiarity with the academic labor setting.
  • Familiarity with all areas of EEO and employment-related compliance including TITLE VII, ADEA, ADA, Section 504 of the Rehabilitation Act, FMLA, WARN and FLSA.


Preferred Qualifications:
  • Experience and training at a top tier law firm or experience working at a college or university.
  • At least seven years of substantive experience practicing as an attorney.
  • Demonstrated commitment to the mission of higher education and public research institutions.
  • Proven success in helping clients improve business processes and policies.
  • Experience supervising outside counsel.


Physical Requirements:
Work is performed in a typical office setting. Sitting, standing, and bending required. May require handling of objects up to 10 lbs.

FLSA: Exempt

Pay Range: Commensurate with experience, $87,682 up to $109,602 (plus 14.2% retirement contribution and other benefits)
