Affirmative Action Officer/Title IX Coordinator

Under the supervision of the Chief Human Resource Officer, the Affirmative Action Officer/Title IX Coordinator is charged with assuring compliance with state and federal requirements for equal employment opportunity as well as compliance with Title IX.  This includes coordinating resources and investigations for complaints received.  This position will work collaboratively with other members of the College community to ensure the College reacts expediently to any complaints.

The Affirmative Action Officer will proactively review policies and practices to assure that decisions with respect to every dimension of employment are made without regard to age, color of skin, disability, gender expression and identity, genetic predisposition, marital status, national origin, race, ethnicity, religion, sex, sexual orientation, veteran's status, status as a victim of domestic violence, and all other protected groups and classes under Federal and State Laws and executive orders. This will include responding to complaints filed by members of the campus community, and coordinating the appropriate investigations and responses.  They will also be responsible for oversight of college searches which includes training search committees, ensuring candidate pools are representative as well as coordinating advertising efforts to recruit a diverse pool of candidates. The Affirmative Action Officer is also responsible for the preparation of the annual affirmative action report.

The Title IX Coordinator will provide coordination and oversight of the College's Title IX activities and will play a key role in the College's collective efforts to maintain a safe and gender-equitable campus climate for all members of the College community. This individual will work collaboratively with the Chief Diversity Officer as well as administrators in Student Conduct, Campus Safety, and Campus Health & Wellness Center, Athletics, Human Resources; Academic Affairs; College Advancement, the President's Office; and others as appropriate with respect to overlapping obligations related to sexual misconduct and compliance with Title IX, the Violence Against Women's Act (VAWA), the Campus Sexual Violence Elimination (SaVE) Act, the Clery Act, New York Education Law 129-B (Enough is Enough), Title VII, and New York Human Rights Law. In this role, they will consult regularly with campus stakeholders to promote campus-wide awareness of Sexual Misconduct.

While experience in human resources, student affairs, and/or regulatory compliance is required for this position, the College is prepared to provide training in conducting investigations for Title VII, and Title IX.  Title VII of the Civil Rights Act prohibits employment discrimination based on race, color, religion, sex and national origins. Title IX of the Education Amendments of 1972 protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance.

Responsibilities:

Compliance

  • Monitor developments and changes in federal, state, and local compliance requirements regarding discrimination and Title IX laws that impact the College; inform the President, members of the Senior Administrative team and/or other College staff, as appropriate.
  • Develop, maintain, and revise policies, procedures, and practices to ensure compliance with applicable federal, state and local laws and rules, and reflect best practices with regard to Title XII and Title IX.
  • Coordinate an effective discrimination and Title IX compliance-training program, including appropriate introductory training for new employees as well as ongoing training for all employees and managers.

Address Sexual Misconduct

  • Lead initiatives to develop, implement and coordinate strategic efforts aimed at the prevention of alleged sex or gender-based discrimination.
  • Coordinate all investigations of violations of Title IX.
  • Maintain a system for reporting and investigative procedures that will ensure complaints, reports, and investigations of sexual misconduct are handled in a prompt, consistent, and equitable manner in accordance with regulations and the College Title IX and Sexual Misconduct policy.
  • Work closely with the Athletic Director to develop and monitor a proactive, comprehensive gender equity plan that includes areas for assessment and articulation of measurable goals. Ensure that intercollegiate athletic participation and the treatment of athletes complies with Title IX.
  • Work collaboratively with other personnel, as appropriate, to develop effective compliance training programs related to Title IX, VAWA, SaVe Act, Clery Act, and Enough is Enough including appropriate introductory training for new employees and students as well as ongoing training for all faculty, staff, and students outlining their rights and obligations under these laws and regulations.
  • Provide ongoing reviews of policies, procedures, publications and practices related to compliance with Title IX, VAWA, SaVE Act, Clery Act, and Enough is Enough. Periodically assess the efficacy of the College's compliance these laws and regulations by conducting periodic audits of regulatory requirements and taking appropriate action to address any systemic patterns or problems identified.
  • Coordinate and/or oversee the development and implementation of regular assessments and/or surveys, including a biennial campus climate survey, analyzing data collected to assess the rates and nature of sexual misconduct, any location hot-spots or risk factors, knowledge of the College's sexual misconduct policies, procedures and resources, the consequences of violating such policies, and the effectiveness of the College's efforts to ensure that the College is free from sexual misconduct.
  • Comply with all applicable College, Federal, State, local, and associational laws, rules and regulations.
  • Contribute to the overall success of the Office of Human Resources and the College by performing other duties and responsibilities as assigned.

Affirmative Action

  • Responsible for investigating and providing a disposition for any complaints of discrimination.
  • Oversee faculty and professional searches including maintaining guidelines, training search committee members, certifying candidate pools, advertising in appropriate venues.
  • Complete the annual affirmative action report.
  • Partner with members of the campus community to ensure the affirmative action plan is being implemented.
  • Recommend policies and practices designed to create a diverse and qualified pool of applicants.

Other Duties:

  • Respond to Civility Complaints by conducting investigations and providing a disposition.
  • Respond to employee ADA requests for accommodations.
  • Facilitate training related to affirmative action, search committees, Title IX and other topics as appropriate.
  • Conduct Exit and Entrance Surveys

MINIMUM QUALIFICATIONS:

  • Bachelor's Degree
  • Experience in Human Resources, Student Affairs, and/or regulatory compliance
  • Proficiency with Microsoft Office software
  • Excellent interpersonal skills


PREFERRED QUALIFICATIONS:

  • Master's Degree
  • Title IX training or certification
  • Experience in compliance
  • Experience in higher education
  • Experience conducting investigations
  • Ability to interpret federal and state non-discrimination laws and regulations

This is a full-time M/C position.
