Title IX Investigator - Position Description

Reporting to the Senior Associate Dean of Students, the Title IX Investigator is responsible for conducting investigations into allegations involving sexual harassment, sexual assault, stalking, dating violence, domestic violence, and sexual misconduct in compliance with Title IX and guidance from the U.S. Department of Education Office for Civil Rights. Provides resources, support, and remedies to parties involved in the investigations. The Title IX Investigator will also assist with adjudicating student conduct cases, including organizational cases and individual cases which may result in suspension, expulsion, or degree revocation. Occasional evening and weekend work may be required.

Duties and Responsibilities

Sexual Misconduct Investigations

Investigate cases of alleged student misconduct (specifically Title IX related matters), which includes meeting with individual students and witnesses, gathering and assessing evidence, determining credibility, and writing investigative reports regarding the findings of the investigation.
Interpret University policies and participate in the implementation of the University's sexual misconduct investigatory and disciplinary processes; provide testimony regarding investigations at University disciplinary hearings, as needed.
Exercise discretion and independent judgment regarding student/faculty/staff problems and concerns regarding the sexual misconduct process.
Evaluate information reported to the Office of the Dean of Students, including anonymous reports and requests for the University to not take action, to determine level of risk to the University community and make sound decisions on case action.
Provide support and referrals to University and community resources as needed for individuals involved in the investigative process.
Evaluate and implement remedies for complainants to rectify a hostile environment.
Collaborate and consult with the Title IX Coordinator and other University officials regarding case concerns, as needed.
Participate in training for students, faculty, and staff regarding the University's grievance procedures.
Monitor compliance with state, local, and federal requirements and timelines specified in the complaint/grievance procedures.
Organize and maintain investigative files, reports, and other compiled records regarding complaints of discrimination, including sexual harassment and gender violence.
Compile statistics regarding reports received in compliance with the Clery Act and other federal, state, and local reporting requirements.
Participate in professional development activities to remain knowledgeable of current state and federal laws, regulations, and trends in the field of education related to harassment and other discriminatory practices that violate Title IX.

Student Conduct

Serve as a University Hearing Officer in the adjudication of student conduct issues (individual and organizational) with an emphasis on student development and growth.
Complete intake process for new referrals for possible violations of university policy.
Monitor cases for compliance with assigned sanctions.
Process and maintain private student records in compliance with the Family Educational Rights & Privacy Act (FERPA)
Serve as a witness as needed and appropriate with the University Hearing Board.
As a member of the Student Rights & Responsibilities unit within the Office of the Dean of Students, actively engage in efforts to enhance practice and procedures, revise publications, and standardize departmental practice.
Serve as a resource and presenter to university departments on topics related to Student Rights & Responsibilities.
Participate in campus efforts to prevent, reduce, and intervene with problematic student behaviors such as underage or excessive alcohol use, among others.

Office of the Dean of Students

Provide assistance to students regarding a variety of student issues/needs, including crisis/personal issues they may be experiencing.
Serve as a member of the SpEAK Team (Speech, Education, Action, and Knowledge) and respond to planned and impromptu expressions of Free Speech on campus by students, faculty, staff, and visitors to campus.
Represent the Office of the Dean of Students at various programs including University Expos and New Student Orientation.
Assist as needed with large-scale university events such as Homecoming, Family Weekend, and Welcome Week.
Coordinate and assist with various special assignments within the Office of the Dean of Students as needed.

Minimum Qualifications

Master's Degree in Student Affairs/Higher Education, Conflict Resolution, Counseling, Psychology, Public Administration/Policy or related field; or Juris Doctor.
Demonstrated understanding of Title IX and related federal and state civil rights laws and regulations; personnel policies and practices; and student programs and related policies.
Evidence of superior judgment with the ability to manage highly sensitive and confidential communications.

Preferred Qualifications

At least three years of full-time professional experience in a collegiate setting with responsibility for student conduct/civil rights investigations or related experience.
Specialized investigator training (i.e. Association for Title IX Administrators training).
Demonstrated mediation, conflict resolution, and/or counseling experience.
