Overview



Employment Status: Full-time, Exempt, At-Will position, included in the Management Personnel Plan (MPP).

Work Schedule: Typically, Monday through Friday from 8:00 a.m. - 5:00 p.m., occasional evenings and weekends as needed.

Compensation: Salary is commensurate with experience and qualifications. A comprehensive benefits package is provided.

The Position:
The Executive Director (ED), Institutional Equity and Compliance, provides leadership in the administration of a comprehensive range of services, policies, and procedures related to equity and compliance. The Executive Director participates in all aspects of institutional planning in support of the mission and goals of the university ensuring that all faculty, students and staff have the opportunity to succeed. The Executive Director assists and supports campus efforts related to diversity, equity and inclusivity as needed. However, the primary responsibilities are to serve as the University Chief Compliance Officer with oversight over campus compliance with Title IX, Discrimination/Harassment/Retaliation (DHR), Whistleblower, and the Americans with Disabilities Act (ADA). These programs are guided in the California State University (CSU) by CSU Executive Order 1095, Executive Order 1096, Executive Order 1097, Executive Order 1111, Executive Order 1115, Executive Order 1116, and CSU Conflict of Interest (COI). The Executive Director serves as the leader of the Office of Institutional Equity and Compliance (OEIC).

The University:
CSUSB is a preeminent center of intellectual and cultural activity in Inland Southern California. Typical Activities

Typical duties include, but are not limited to:
Policy and Procedure Development and Maintenance:
  • Serve as University official with primary responsibility for ensuring campus compliance with state and federal Equity-related laws and related CSU executive order policies and procedures.
  • Foster a culture and climate that provides for and supports a long-term vision for compliance with Title IX, DHR, OHR, ADA, and Whistleblower policy (collectively Equity) laws which will enhance a safe and respectful campus environment.
  • Communicate equity-related CSU executive order policies and procedures to the campus community. In addition, utilizing accessibility standards, place this information in a web-based format and maintain/develop content of the Equity webpage.
  • Leads creation of necessary forms (e.g., incident reporting form, notification forms, etc.), and campus complaint reporting procedures for violations of Equity laws and related CSU executive orders.
  • Interpret and apply Equity laws and regulations to assure campus compliance.
  • Remain knowledgeable of current state and federal laws, regulations, and trends in the field of higher education related to harassment and other discriminatory practices that violate Equity laws.
  • Ensure prompt, effective, equitable investigation and timely resolution of all complaints related to Equity policies.
  • Provide oversight and guidance to investigators assigned with responsibilities in resolving Equity complaints and work collaboratively with members of the campus community to promote informed and consistent communication about related CSU executive orders.
Consultation, Investigation, and Disposition:
  • Review information and recommendations from assigned investigators, working with the Office of General Counsel when appropriate, make final decision, and issue final dispositions on complaints to relevant parties.
  • Receive, investigate, and process, in a timely manner, complainants or complaints from third parties who report knowledge of discrimination, harassment or retaliation in violation of Equity related CSU executive orders.
  • Notify complainants of acceptance or non-acceptance of an Equity complaint and notify respondent(s) and supervisor/manager of respondent that complaint has been made
  • Manage Equity investigations presented by faculty, staff, students and applicable third parties including interviews of complainants, respondents, and material witnesses, and obtain/review documents and other relevant materials within CSU executive order timelines and processes.
  • As necessary, the incumbent may conduct investigations for highly sensitive subject matters, in response to unit workload demands, and/or as other operational realities require.
  • As necessary issue findings of fact and recommendations for disposition of complaints and notify parties.
  • Monitor compliance of all requirements and timelines specified in the complaint/grievance procedures.
  • Regularly attend Equity training to ensure compliance with investigative standards and continuously identify and integrate best practices as they relate to Equity processes.
  • Provide ongoing consultation regarding Equity requirements and the University's compliance program to the Vice Presidents and Associate Vice Presidents, and others as appropriate.
Monitoring and Compliance:
  • Track and analyze reported incidents, informal and formal complaints, and investigations to identify and address any systemic problems.
  • Coordinate and monitor Equity efforts with University offices that receive and/or investigate complaints, including but not limited to: Faculty Affairs, Athletics, Student Affairs/Student Conduct, Human Resources (Employee/Labor Relations; Employee Organizational Development and Advancement), University Police Department, University Ombuds, and other cross-divisional entities.
  • Responsible for the organization and maintenance of complaint files, disposition reports, and other compiled records, including annual descriptive reports of number and nature of filed complaints and disposition of complaints.
  • Oversee, review and coordinate University response to EEOC/DFEH complaint notices;
  • Monitor University policies and procedures to ensure compliance with state and federal Equity laws and regulations and CSU Executive Orders.
  • Provide periodic and annual reports as appropriate.
  • Provide adequate resolution of issues noted in internal audit reports or external agency reports.
  • Analyze trends, compile and monitor campus data/records pertaining to training, complaints, investigations and findings related to sexual harassment, sexual violence, and gender discrimination to assess effectiveness of campus efforts to prevent behaviors and to recommend changes as appropriate.
  • Report campus compliance to Chancellor's Office Executive Management.
Management and Supervision:
  • Oversees the production of mandated Equity statistical reports. Analyzes data to develop, recommend, and implement programs and procedures to achieve the University's Equity initiatives and compliance with applicable laws.
  • Makes related presentations as needed to campus constituents.
  • Provides performance feedback to the staff including completing performance evaluations, mentoring, training and development
Campus Education and Training:
  • In collaboration with critical campus stakeholders, Executive Director will help develop, implement, and coordinate strategic efforts aimed at the prevention of discrimination on the basis of any protected category.
  • Responsible for ensuring all students, employees, contractors and volunteers complete the applicable campus mandated compliance trainings including but not limited to the annual Title IX training, the DHR training, Mandated Reporter training and the Conflict of Interest training.
  • Prepare and disseminate educational materials, including brochures, posters, and web-based materials that inform members of the campus community of their rights and responsibilities.
  • Oversee coordination training and communication efforts to ensure greater inclusivity. Coordinate training for faculty, staff, and students about their rights and CSU executive order complaint procedures.
  • Oversee coordination of in-service training to all employees concerning CSU executive order policies and procedures and reporting of sexual harassment/sexual violence incidents.
  • Formulates procedures for supervisors, in alignment with the University's vision, mission, core values, CBA's policies, procedures, as well as federal, state, and local laws.
  • Train staff responsible for implementing CSU executive order complaint procedures.
  • Other duties as assigned.


Minimum Qualifications

Education & Experience:
  • Bachelor's degree in legal studies, public administration, human resources management, business administration or related fields.
  • Five (5) years progressively responsible experience in complaint resolution and investigation, higher education administration, human resources management, or EEO/ADA compliance, including significant experience in handling various types of investigations related to sexual harassment, discrimination, retaliation, Conflict of Interest violations, Improper Governmental Activities and/or Title IX violations.
  • Three (3) years of progressively responsible management experience in a compliance, human resources, higher education administration, or legal field.
Preferred Qualifications:
  • Master's Degree or Juris Doctorate
  • Association of Title IX Administrators Certification
  • Association of Work Place Investigators Certification
Knowledge, Skills & Abilities:
  • Knowledge of federal and state equal employment, disability, and family medical leave law and regulations, including Title V, Title II, Title VII, Title IX, and Sections 503, 504, and 508 of the Rehabilitation Act; all pertinent sections of the Americans Disabilities Act; and federally mandated affirmative action plans under the US Department of Labor, Office of Federal Contract and Compliance Programs.
  • Knowledge of trends in the field of Whistleblower and Whistleblower Retaliation claims, including working knowledge of improper governmental activities;
  • Ability to apply legal and policy standards. Excellent interpersonal, oral and written communication skills.
  • Excellent research, problem solving and conflict resolution skills.
  • Excellent organizational and analytical skills. The ability to develop and deliver effective training and materials.
  • Excellent ability to clearly communicate ideas and recommendations and to write clear and concise investigative reports. Ability to maintain confidentiality and act with professionalism, sensitivity and neutrality. Ability to use appropriate judgment when making decisions and recommendations. Attention to detail is required.
  • Presentation and facilitation skills with emphasis on education and training for a wide audience, including but not limited to students, faculty and staff with responsibilities in resolving sexual harassment/sexual violence, Title IX and VAWA complaints and with supervisor responsibility, and those whose day-to-day responsibilities involve working closely with students.
